WW2 (6/18/2008)
LOL, I'm sure you do.....thanks for your input. I'll keep an eye out for the only guy in Gulf Breeze doing 20mph through that huge school zone when the signs aren't flashing...

oh and if you read my post you will see that I clearly forgot about the school zone as I was leaving, thus the statement that I thought the sign should be there to REMIND people that school is in session. See, that is what the signs are for, they are there to remind you of what you should be doing. Otherwise there is no reason to have them.

You forgot?  Now, you're just making yourself look even dumber, since you said you've lived there for 14 years...did they just build those 3 schools in the past few weeks?  Were you deployed to a combat zone or in the hospital in a coma for the last year and it was your first day back behind the wheel?  Man up, dude, and take your lumps.

WW2 I had the same thing happen to me about 5 years ago or so.  I was picking my mom up from work and had my g/f in the back seat.  We were all talking and joking when I came onto Stewart from a side street.  I went to school at Milton High and knew exactly what times the zone signs came on and off.  I simply didn't pay attention to the time b/c i was yaking with my mom and g/f.  I ended up doing 27 in a school zone.  As soon as I realized why i was going faster then the other drivers I saw blue lights.

It went like this:

Me - the light is blinking isn't it

Officer - yep, why were you speeding

Me- I came in on a side street and didn't see the sign, I just realized what I was doing when I saw your lights

Officer - (making a hand gesture) do you know what this means

Me - no

Officer - pull your head out of your a$$

Me - um okay

Officer - have a nice day

Ron, what can I say...

It looks like HB has done a thorough statistical anaylsis with regards to entering school zones from unposted side streets and identified all of the possible outcomes.  I for one am grateful for his cogent analysis and expository exegesis of WW2'S UNIQUE SITUATION...

While I can understand your frustration, and I read that the judge didnt look at  your evidence, they have to decide on what evidence is surely there. There is a fact that you were 11 mph over the speed limit. That is speeding. He cant surely agree that you didnt see the sign from the backside or know that a school zone was active, because only you know that for sure. You have to understand that alot of people say i didnt know or take pictures to prove their case. If you stand up there and state that you were over the limit and that the zone was blinking( even though you didnt see it), you are guilty based on your own admission. They increase the fines to cover court costs and the cost of the officers having to come to court. I have seen a guy contest a speeding ticket ( like 50 in a 35) . He took a picture of his speedometer showing 35 mph on it. He then told the judge that he snapped the photo at the same time the officer clocked him on radar. It was the most stupid thing i have ever seen in court. I would have jailed him for lying. Just my .02 cents....

I got zinged going through a school zone on 10/17/2007. I know that exact date because a NC trooper in that area was killed yesterday so I went to look at my ticket to see if it was him. Even though he gave me a ticket, I am glad it wasn't him. I feel sorry for trooper Blanton that was killed and I am not a real fan of cops but hey, if I do the crime, I pay the fine. He had me dead to rights even though I was a newbie to the area.

I had leased a house in NC thinking I might buy property up there. The school was behind a hill and you could BARELY see the tops of the buses from the highway much less any buildings. Anyway, he got my license, ins, etc.. asked how long I had been in the area, etc.. I told him I had just leased a house and he wrote me up BUT he didn't write me up for blowing through a school zone, just a regular ticket.

I turned around, drove straight to the courthouse and laid a $100.00 and a $50.00 bill on the clerks desk and asked for a receipt. This was literally about 20 minutes after the ticket. She looked at me kind of curiously and stated the ticket wasn't in her system yet. I didn't expect it to be so soon so I insisted on a cash receipt in case I got pulled over again in NC.

Anyway, sorry to hear about your experience with Judge Hilliard. Send me $$$$$$ and I'll give you his personal cell # j/k I have it but it ain't for sale.

Yeah, I could honestly care less about the money, it has nothing to do with that, and as stated before when I know I'm in the wrong I just write the check. This was the first time I honestly felt I had done nothing wrong and I thought surely the simplest of logic would make it easy to understand how I made the mistake.

Don't worry WW2.

We will blame it on President Bush but don't worry, OBAMA will CHANGE it.

I'm with Harry on this one. Yes, maybe the judge was a ARSE and wanted to show you what HE COULD DO.

If I were on a jury and this was in court, I know no juries for this type of thing, I would find you guilty. I would say the judge was a prick and you are guilty of speeding in a school zone.

MY GUESS, and its an opinion like an asshole, is that when you wanted to show the judge the law on the statue of school zones the judge wanted to show you the law and doubled your fine.

I'm glad I don't live in a black and white world...  Of course the land of jurisprudence with all of its grey area has a lot to be desired if the system is not allowed to work, but this horse is beat to death at this point...

This was a small town I was in, their library was struggling. I had written them a personal check the day before for 1k, they about shit as a 1 year membership was $10.00 and that came with a hand tote. I intended to give them more but the trooper kinda soured me on that. I asked him for a break and promised him I would never purposefully blow through a school zone having three children myself.

He chose not to cut me a break. I closed my checkbook to the community and paid my fine. Problem solved. I am going back up there in a few weeks, I'll probably stop in and make a donation. Small town libraries get my support, not the monuments to society that I see in some places. It is all about the books, not the building, you do not need eyecandy for bookshelves but I digress......

Regards to all,

NC

It seems unfair to me that the judge raised your fine because you came in to defend yourself. Isnt that why you go to court is so you can plead your case without any bias and if he agrees with your points then he lets you go and if he does not then you pay the fine but I dont think he should raise your fine because you tried to prove your point. In Harrys post he said he comes home at 5 and HE KNOWS schools are out by then. Well they are keeping them later and later these days so you never know when they are in and when they are not. But if you had a sign that told you what times they get out then there would be no questions. And with anything there needs to be some common sense involved in anything you do. Cops dont interpret the law they just enforce it but there needs to be some common sense involved. Anytime you get involved with the justice system expect the run around. Guilty or not. Remember its all about the money
